Cohart, Inc. ("COHART,” "we,” "our,” and/or "us”) values the privacy of individuals who use our application, website, and related services (collectively, our "Services”). This privacy policy (the "Privacy Policy”) explains how we collect, use, and share information from users of our Services ("Users”). If you are located in the European Economic Area ("EEA”) or the United Kingdom ("UK”), "information” means any information relating to an identified or identifiable individual. By using our Services, you agree to the collection, use, disclosure, and procedures this Privacy Policy describes. Beyond the Privacy Policy, your use of our Services is also subject to our Terms of Service
Information We Collect
We may collect a variety of information from or about you or your devices from various sources, as described below.
A. Information You Provide to Us
Registration and Profile Information. When you register to use our Services or sign up for notifications or updates, we ask you for your name, username, your interests, and email address. You can choose to add additional information, such as your mailing address and phone number. You may choose to provide information for your publicly accessible bio, including your website, username on other platforms, photographs, videos, location, interests, events you have attended in the past, your current artistic projects, and organizations with whom you are affiliated. If you sign up using a Twitter account, we will also receive information from Twitter, Google, and Apple, such as your name, email address, language preferences, and profile photo.
Communications. If you contact us directly, we may receive additional information about you. For example, when you contact us for customer support, we will receive your name, email address, the contents of a message or attachments that you may send to us, and other information you choose to provide. When you communicate with us online, third-party service providers may receive and store these communications on our behalf. If you subscribe to our newsletter, then we will collect certain information from you, such as your email address. When we send you emails, we may track whether you open them to learn how to deliver a better customer experience and improve our Services.
Posts, Images, and Videos. You may choose to upload images, videos, comments, and other posts, for instance relating to your artistic works, or on forums engaging with other Users' artwork.
Payment Information. If you make a purchase through our Services, your payment-related information, such as credit card, virtual currency wallet information, or other financial information, is collected by our third-party payment processor or third-party service provider on our behalf. We may receive information about your transaction, such as when it was made, the artwork, product, or services purchased, and amounts paid or received.
Art Curation. COHART allows Users to sign up through a questionnaire to get personalized suggestions on artwork Users can purchase. If you choose to participate, we will ask you for your name, email address, vibes, values, why you are looking for art, and a price range in which you would purchase the art.
Information Collection Related to Link-in-Bio. In addition to the existing data collection practices, we collect and store any social media profile links you choose to associate with your Portfolio to enhance your profile visibility and direct sales capabilities. This may include your public profile information and any content related to sales activities on your social media platforms.
B. Information We Collect When You Use Our Services
Location Information. We infer your general location information, for example by using your internet protocol (IP) address.
Device Information. We receive information about the device and software you use to access our Services, including IP address, web browser type, operating system version, phone carrier and manufacturer, device identifiers, mobile advertising identifiers, and push notification tokens.
Usage Information. To help us understand how you use our Services and to help us improve them, we automatically receive information about your interactions with our Services. This includes the pages or other content you view, the searches you conduct, people you connect with and follow, the content you like or comment on, any content you post, and the dates and times of your visits. We also collectinformation about your video-related activity, such as broadcasts, including live streams and events you create, join or view. The information collected through the Link-in-Bio feature will be used to facilitate direct transactions and to personalize your sales experience by integrating with your social media profiles. This includes using your provided information to promote your Portfolio to potential buyers, streamline the sales process, and offer you tailored support and recommendations based on your activity.
Your Contacts. If you permit us to access the address book on your device, we will access and store names and contact information from your address book to facilitate invitations and other social interactions that you choose to use through our Services, and for other purposes described in this privacy policy or at the time of consent or collection. We also collect information about your contacts if you invite them to use our Services or if you share information or content with them through our Services. You can disable our access to your address book at any time in your device settings.
Information from Cookies and Similar Technologies. We and our third-party partners may collect information using cookies and similar technologies. Cookies are small files of letters and numbers that we store on your browser or your device’s shard drive and contain information that is transferred to your device. We and our third-party partners may also use pixel tags and web beacons on our Services and in our emails These are tiny graphic images placed on web pages or in our emails that allow us to determine whether you have performed a specific action (for example, opening an email or viewing a page). We use cookies, beacons, invisible tags, and similar technologies (collectively "Cookies") to collect information about your browsing activities and to distinguish you from other users of our Services. Cookies and Similar Technologies (Link-in-Bio). To enhance your experience with the Link-in-Bio, we may use Cookies and similar tracking technologies to monitor your interactions with the feature. These technologies help us understand user behavior, manage content, and improve our offerings.
Communications Between Users. You may use the Services to communicate with other Users. When you do so, we receive information about these communications, such as the date and time of the message, and the content of the communications, to operate and provide the Services. For security purposes, fraud prevention and support purposes, we and service providers acting on our behalf may monitor and/or record these communications in accordance with applicable law and your account settings.
We may send you service-related notifications about your Link-in Bio, such as alerts about important updates to the Services. Where permitted by applicable law (and where required, with your consent), we may also send you promotional messages related to your Link-in-Bio, including alerts about sales activities, new feature updates, and tips for optimizing your Link-in-Bio. You can opt out of received promotional messages at any time following the unsubscribe instructions in those messages or by updating your preferences in your account settings.
C. Information We Receive from Third Parties
Information from third-party services. If you choose to link our Services to a third-party account, we may receive information about you, including your profile information and your photo, language preferences, and your use of the third-party account. If you wish to limit the information available to us, you should visit the privacy settings of your third-party accounts to learn about your options.
How We Use the Information We Collect
We use the information we collect:

Legal Bases For Processing European Information
If you are located in the European Economic Area or the United Kingdom, we only process your information when we have a valid “legal basis,” including as set forth below.
How We Share the Information We Collect
Vendors and Service Providers. We may share the information we receive with vendors and service providers that we engage to help us operate, provide, maintain, and improve our Services. Payment processing is handled by Stripe, Inc. We do not store your full payment card details; this information is collected and processed directly by Stripe. Stripe is certified under the EU-US Data Privacy Framework. For more information about how Stripe handles your payment data, please see Stripe’s Privacy Policy at https://stripe.com/privacy.
User Content. Our Services are social services in which you can find, enjoy, and share content. Your name, username, biography, your artwork, artwork or videos that you saved, videos you posted, your favorite profiles, your interests, the organizations with whom you are affiliated, events you have attended in the past, your current artistic projects and other profile information will always be viewable and searchable by other users. The content you post to the Services will be displayed on the Services and viewable by other users. We are not responsible for the other users' use of available information, so you should carefully consider whether and what to post or how you identify yourself on the Services.
Third-Party App Integrations. If you chose to connect our Services with a third-party application or web service to our Services, we may disclose certain information such as your name, email address, language and photograph to that third party.
Social Networks and Other Online Services. Our Services allow you to, upon your direction, share information with social networking services, such as Twitter and Instagram. You understand and agree that the use of your information by any social networking websites will be governed by the privacy policies of these third-party platforms and your settings on that platform. We encourage you to review their privacy policies.
Analytics Partners. We use analytics services such as Google Analytics to collect and process certain analytics data. You can also download the Google Analytics Opt-out Browser Add-on to prevent their data from being used by Google Analytics at https://tools.google.com/dlpage/gaoptout.
Sharing Between Users. If you engage in private chats with other Users through our Services, for instance to purchase artwork, we share information needed to enable that that conversation and related transactions. This may include your name, your phone number, your email address, the date and time of your message, and the contents of messages. With your consent, or where necessary to complete a transaction (for example, arranging delivery), we may also share your contact details, such as your email address or phone number, with the other User.
As Required By Law and Similar Disclosures. We may access, preserve, and disclose your information if we believe doing so is required or appropriate to: (a) comply with law enforcement requests and legal process, such as a court order or subpoena; (b) respond to your requests; or (c) protect your, our, or others’ rights, property, or safety. For the avoidance of doubt, the disclosure of your information may occur if you post any objectionable content on or through the Services.
Merger, Sale, or Other Asset Transfers. We may transfer your information to service providers, advisors, potential transactional partners, or other third parties in connection with the consideration, negotiation, or completion of a corporate transaction in which we are acquired by or merged with another company or we sell, liquidate, or transfer all or a portion of our assets. Your Choices
Sharing Preferences. We provide you with settings to allow you to set your sharing preferences for content you post to the Services.
Marketing Communications. You can unsubscribe from our promotional emails via the link provided in the emails. Even if you opt-out of receiving promotional messages from us, you will continue to receive administrative messages from us. Your consent requirements for receiving marketing communications depend on your jurisdiction. If you are located in the EU or UK, we will only send you marketing communications via email, text message, or other electronic means if you have affirmatively opted in to receive such communications, in accordance with the General Data Protection Regulation (GDPR) and the Privacy and Electronic Communications Regulations (PECR). In the EU and UK, business contact information (such as name, business email addresses, and job titles) is considered personal data, and marketing communications to business contacts in the EU or UK require opt-in consent.

We do not make decisions based solely on automated processing, including profiling that produce legal or similarly significant effects.

Before fulfilling your request, we may ask you to provide reasonable information to verify your identity. Please note that there are exceptions and limitations to each of these rights, and that while any changes you make will be reflected in active user databases instantly or within a reasonable period of time, we may retain information for backups, archiving, prevention of fraud and abuse, analytics, satisfaction of legal obligations, or where we otherwise reasonably believe that we have a legitimate reason to do so.
How to Block Cookies

However, if you use your browser settings to block all Cookies (including essential Cookies) you may not be able to access all or parts of our Services. Our Services may contain links to other websites, products, or services that we do not own or operate. We are not responsible for the privacy practices of these third parties. Retention
We take measures to delete your information or keep it in a form that does not permit identifying you when this information is no longer necessary for the purposes for which we process it, unless we are required by law to keep this information for a longer period. When we process information for our own purposes, we determine the retention period taking into account various criteria, such as the type of services provided to you, the nature and length of our relationship with you, possible re-enrollment with our Services, the impact on our Services we provide to you if we delete some information from or about you, and mandatory retention periods provided by law and the statute of limitations.
Security
We make reasonable efforts to protect your information by using physical and electronic safeguards designed to improve the security of the information we maintain. However, as no electronic transmission or storage of information can be entirely secure, we can make no guarantees as to the security or privacy of your information.
Children's Privacy
We do not knowingly collect, maintain, or use personal information from children under 16 years of age, and no part of our Services are directed to children. International Visitors
Your personal information may be transferred to, and processed in, countries other than the country in which you are a resident. These counties may have data protection laws that are different to the laws of your country.
Our Services are hosted in the United States. If you choose to use the Services from the EEA, the UK or other regions of the world with laws governing data collection and use that may differ from U.S. law, then please note that you are transferring your information outside of those regions to the U.S. for storage and processing. We may transfer information from the EEA or the UK to the U.S. and other third countries based on European Commission-approved or UK Government-approved Standard Contractual Clauses, or otherwise in accordance with applicable data protection laws.
